Description

Attested Copy of the Will of Thomas Stanton of the Parish of St. Mary Magdalen, Bermondsey, Surrey gentleman whereby he bequeathed to his brothers [in law] Richard Mills and John Best £150 in trust to apply the profits for the maintenance of the Testator's sister Mary Woodall during her life and thereafter for such person or persons as the said Mary Woodall should by Will appoint and for want of such appointment then to her Executors or Administrators absolutely. And he gave to the said Richard Mills and John Best £200 in trust for the maintenance of the Testator's kinswoman Sarah Voss during her life, remainder to the surviving children of the body of the said Sarah Voss and for want of such issue to the Executors or Administrators of the Will of Sarah Voss absolutely, and he bequeathed an Annuity of £10 to Sarah Voss for her life for her separate estate in equity and he bequeathed to the said Richard Mills and John Best a further sum of £300 in trust for Sarah Voss for her life with restraint upon anticipation and after her decease in trust as to £150 for the said John Best absolutely and as to the residue to such persons as the said Mary Woodall should by Will appoint, and the Testator gave to his kinsman John Aylworth clerk, son of Thomas Aylworth of Wellesbourne Mountford gentleman deceased during his life the Advowson of Wolverton Church and after his decease he gave the said Advowson to John Stanton of Longbridge and his heirs for ever. And he devised all the hereditaments in the County of Warwick (devised to the Testator by Thomas Stanton deceased, see DR 38/1022) except the said Advowson to Richard Mills and John Best upon trust to discharge all debts etc. thereout of the Testator's personal estate was not sufficient for the purpose. Provided that the said Richard Mills and John Best and their heirs (in payment of £800 at interest of 5% from the date of the said Will by John Stanton to the said Richard Mills and John Best) should re-convey to the said John Stanton and his heirs all the aforesaid hereditaments subject to such debts and legacies should be unpaid in case his personal estate should fall short and subject to the payment of £280 with interest then charged upon the said premises and all other incumbrances charged thereon except two Mortgages for £560 and £309-14-11 (expressed to be due to Richard Mills and John Best, but which monies were in fact the monies of the Testator) and that the sum of £800 should be applied to the payment of debts and legacies etc. And the Testator devised and bequeathed all the residue of his estate to his Executors Richard Mills and John Best. Witnessed by Elizabeth Harmon, William Holloway, Notary Publick and Abraham Harmon, his clerk. Attested 15th April 1766 by Theobald Walford, clerk to William Hunt, and Thomas Cleaver.
