Attested Copy Indenture of Assignment between Sir Charles Mordaunt of Walton baronet Newsham Pears of Alveston esquire of the 1st part, Sir Hugh Clopton of Stratford-upon-Avon knight, Henry Talbott of the Parish of St. George, Hanover Square, Middlesex esquire Katherine his wife, Thomas Boothby Skrymsher of the same place esquire Ann his wife of the 2nd part and Mary Jones of the same place widow Mary Jones spinster, her daughter and others of the 3rd part. Reciting DR38/1173, DR38/1174 DR38/1178, it was thereby witnessed that Sir Charles Mordaunt and Newsham Pears in consideration of £1400 paid to Thomas Mortiboyes and £126-16-0 paid to Robert Harper esquire for the expenses of framing the Act of 1741 and of several other sums mentioned therein amounting in total to £3500 as well in consideration of 5/- apiece paid to them by Mary Jones widow and Mary Jones spinster at the direction of Sir Hugh Clopton, Henry Talbott Katherine his wife, Thomas Boothby Skrymsher and Ann his wife assigned the term of 1000 years created by the Act of 1741 in the premises described in DR 38/1173 to Mary Jones widow and Mary Jones spinster subject to a proviso for redemption upon repayment of £3500 by Sir Hugh Clopton. Witnessed by David Thomas and Edward Lewis. Schedule of debts and receipts therefore attached. Copy Bond for £3500 by Sir Hugh Clopton to Mary Jones widow and Mary Jones spinster. Witnessed by Henry Turbitt and Thomas Vigas. Deed Poll dated 27th August 1754 endorsed upon and attached to the above Copy Indenture dated 1st January 1742 under the hand and seal of Henry Talbot reciting the Act of 1741 (see DR 38/1178) whereby a term of 1000 years was limited to Sir Charles Mordaunt and Newsham Pears on trust to raise £3320-14-0 and also to pay so much of the sum of £700 in the said Act mentioned to be secured by a Bond from Sir Hugh Clopton to Thomas Boothby Skrymsher esquire to be paid on the death of Sir Hugh Clopton, as his personal estate liable to the payment of the said Bond would fall short or be deficient to pay and reciting the death of Sir Hugh Clopton on 24th December 1751 without issue other than Katherine Talbot and Ann Skrymsher having by his Will dated 23rd December 1745 bequeathed to his son-in-law Henry Talbot the residue of his real and personal estate and appointed him his Executor, it was thereby witnessed that Henry Talbot in consideration of £500 to him paid by Mary Jones widow and Mary Jones spinster charged the hereditaments mentioned in the Indenture of 1st January 1742 with the repayment thereof (as well as the £3500).
