Attested Copy Indenture between Hugh Clopton of the Middle Temple, London esquire of the 1st part, the Right Honourable Thomas Charles Lord Viscount Tracy of Rashule, County Dublin, Ireland and Sir William Keyte of Norton, Gloucestershire baronet of the 2nd part and Thomas Mason of New Inn, Middlesex gentleman Bartlett Mason of Stratford-upon-Avon gentleman of the 3rd part whereby Hugh Clopton in consideration of 10/- to him paid by Thomas Charles, Lord Viscount Tracy and Sir William Keyte granted to the said Thomas Charles, Lord Viscount Tracy and Sir William Keyte 3 closes in Clopton adjoining the Common Fields of Old Stratford and Bishopton called Jakeman's Ground containing 28 acres (one of which was called Spires Close), also 3 closes in Clopton called Edkins Leasowes also Furzen Hill all which last mentioned premises contain 50 acres also part of Clopton Park called Grove Leasowe lying in Clopton Park then disparked containing 26 acres, also a meadow in Clopton called Smart's Close (9 acres), also Windmill Ground and all tithes of corn and hay arising therefrom also a messuage and farm in Ingon including Hogg Leasowes, Hogg Leasowe Meadow, Poole Leasowes, Poole Leasowe Meadow and Roman Close containing together 130 acres also Sally Closes consisting of 8 closes :- one in the tenure of Matthew Collett adjoining Owen's Farm, two in the tenure of John Wake adjoining certain lands belonging to the Chamber of Stratford, three in the occupation of Widow Fletcher adjoining Shipston Lane, one close called Clayhill in the tenure of Samuel Barber and the remaining close in the tenure of Joseph Castle adjoining Owen's Farm also tithes of corn and hay arising therefrom which last mentioned premises were situate in Ryhen Clifford and Bridgetown together with all appurtenances to the use of the said Thomas Charles Lord Viscount Tracy and William Keyte for a term of 99 years upon trust to raise a sum of £1000 to be paid to Hugh Clopton or such person as he should appoint, remainder to the use of Hugh Clopton for life, remainder to Charles Thomas, Lord Viscount Tracy and Sir William Keyte in trust to preserve contingent remainders and thereafter as touching the said farm at Ingon he charged the same with a payment of an Annuity of £16 to the Mayor, Aldermen and Burgesses of Stratford-upon-Avon and subject thereto as to and concerning the said farm at Ingon as also all other the premises mentioned to the use of Thomas Mason and Bartlett Mason for a term of 100 years in trust to discharge all the debts of the said Hugh Clopton, remainder to the use of the first and other sons successively in tail male of Hugh Clopton and in default of such issue to the use of Henry Talbott and Katherine his wife (youngest daughter of Hugh Clopton) for their lives, remainder to Charles Thomas, Lord Viscount Tracy and Sir William Keyte bar upon trust to preserve contingent remainders, remainder to the use of the first and other sons successively in tail male of Henry Talbott and the said Katherine, remainder to all the other sons successively in tail male of the said Katherine by any other husband and in default of such issue to the use of the second son of the body of Ann Boothby Skrymsher (eldest daughter of the said Hugh Clopton) by Thomas Boothby Skrymsher esquire, her husband and the heirs male of his body, remainder to the third and other sons successively in tail male of the said Ann by Thomas Boothby Skrymsher, remainder to the other sons successively of the said Ann by any other husband, remainder to the use of John Clopton (eldest son of Edward Clopton and nephew of the said Hugh Clopton) for his life, remainder to Charles Thomas, Lord Viscount Tracy and Sir William Keyte baronet to preserve contingent remainders and thereafter to the first and other sons of John Clopton successively in tail male, remainder in default of such issue to John Ingram, second son of Barbara Ingram widow (sister of the said Hugh Clopton) for life, remainder to the said Viscount Tracy and Sir William Keyte to preserve contingent remainders, remainder to the first and other sons of John Ingram successively in tail male, remainder to Edward Ingram, youngest son of the said Barbara Ingram for life, remainder to Viscount Tracy and Sir William Keyte to preserve contingent remainders, remainder to the first and other sons of Edward Ingram successively in tail male, remainder to the said Hugh Clopton and his heirs for ever. Proviso giving power to Hugh Clopton the Settler to revoke and re-appoint by Deed inter vivos or by Will any of the Trusts of the above settlement. Witnessed by Robert Meese and Edward Allen. Endorsed on the back an Appointment dated 9th February 1740 confirming that all estates prior to that limited to John Clopton and revoking the estate limited to John Clopton and there following. Re-appointing that the said Viscount Tracy and Sir William Keyte should stand seised to the use of Sir Hugh Clopton and his heirs.
