Indentures of Release and Declaration of Trust between John Payton of Stratford-upon-Avon gentleman (only son and heir of John Payton late of the same place innholder who died intestate) and Elizabeth his wife of the 1st part, Charles Pestell of the same place surgeon, John Whateley of Chadshunt and Edward Townsend Higgins of Tiddington gentleman of the 2nd part and William Dester of Edstone in the Parish of Wootton Wawen gentleman of the 3rd part. Reciting that John Payton was indebted to several persons and had agreed to assign all his real and personal property to Trustees, it was thereby witnessed that John Payton conveyed the premises described in DR 38/1282 to Charles Pestell, John Whateley and Edward Townsend Higgins on trust to sell the same for the benefit of creditors and upon further trust after settlements of all debts to re-convey the same to John Payton. Covenant by John Payton and Elizabeth his wife to levy a fine of the premises to William Dester to the use of Charles Pestell, John Whateley and ed Townsend Higgins upon the trusts aforesaid.
