Description

Attested Copy Indenture (indorsed on a Marriage Settlement of Charles Thomas Warde esquire and Miss Marianne Lawes dated 18th October 1834, DR38/1311) between Charles Thomas Warde of Clopton House and Marianne his wife (late Marianne Lawes) of the 1st part, John Bennett Lawes of Rothamstead, Hertfordshire esquire John Morford Cottle surgeon of Leamington (surviving Trustees of the Settlement) and Richard Marriott Freeman of Bartlett's Buildings, London gentleman of the 3rd part, Henry Bury of Manchester gentleman of the 4th part and Charles Thomas Warde of Clopton House of the 5th part. Reciting that Charles Thomas Warde in order to proceed with the sale thereof and to discharge the premises referred to in DR38/1311 from all trusts limited by DR38/1311 had paid to the Trustees of the said Settlement £20,000 (according to a power contained therein) and that the mortgage of £14,000 had been paid off, it was thereby witnessed that in consideration of £20,000 paid by Charles Thomas Warde to the said Trustees, also in consideration of 5/- by Henry Bury paid to Charles Thomas Warde and Marianne his wife, they the said John Bennett Lawes, John Morford Cottle and Richard Freeman (at the direction of Charles Thomas Warde and Marianne his wife) and the said Charles Thomas Warde and Marianne his wife conveyed the premises referred to in DR38/1311 to Henry Bury to the use of Charles Thomas Warde and his heirs for ever free from all trusts and encumbrances. Witnessed by Henry O. Hunt, solicitor, Stratford-upon-Avon, A. Haynes, solicitor, Leamington, Thomas Umbers, solicitor, Stratford-upon-Avon and E. S. Bradshaw, Priors Marston. Attested by Robert Watts and Robert Humphreys 28th October 1845.
