Attested Copies of Lease and Release, the Release dated 4th March 1800 between Charles Pestell of Stratford-upon-Avon surgeon, John Reason of Shottery gentleman and Jonathan Izod of Stratford-upon-Avon plumber and Glazier (Devisees, Trustees and executors named in the Will of Samuel Smith late of Stratford-upon-Avon gentleman deceased) of the 1st part, Hannah Smith of Stratford-upon-Avon (widow of the said Samuel Smith deceased) of the 2nd part and Samuel Smith of Stratford-upon-Avon gentleman (eldest son and heir at law of Samuel Smith deceased) of the 3rd part. Reciting the Will of Samuel Smith deceased (DR38/1328) and the death of the Testator and that Samuel Smith the son had then recently attained 24 years and that it had been agreed between the Trustees of the Will of Samuel Smith deceased and Samuel Smith the younger that Samuel Smith on paying the sums of £400 to his mother Hannah Smith and £400 to each of the younger children of Samuel Smith deceased as directed by the said Will should have conveyed to him not only the farm premises mentioned in the said Will but also all stock, cattle, chattels, effects and other personal estate which Samuel Smith was possessed of at the time of his death. It was thereby witnessed that Charles Pestell, John Reason and Jonathan Izod in consideration of 10/- to them paid by Samuel Smith granted to the said Samuel Smith the hereditaments referred to in DR38/1328 and all other the hereditaments which Samuel Smith the elder died seised except a messuage then divided into 4 messuages with gardens etc. in the Rother market, Stratford-upon-Avon and by the said Charles Pestell, John Reason and Jonathan Izod agreed to be sold to John Handy of Stratford-upon-Avon bricklayer and it was further witnessed that the said Charles Pestell, John Reason and Jonathan Izod in consideration of 10/- to them paid by Samuel Smith the younger assigned to him all stock, household goods and other things used in and about the said farm by Samuel Smith the elder together with all book debts etc. and it was further witnessed that whereas the said sum of £400 bequeathed to Hannah Smith by the said Testator was in lieu dower of the said Hannah Smith in consideration of 10/- to her paid by Samuel Smith the younger released to him all her interest or claim in the said farm premises in respect of dower. Witnessed by Thomas Hunt, Thomas Smith and James Barron. Attested 1st March 1804 by Henry Wyatt and W. George, clerks to Mr. Wyatt. Copy Lease dated 3rd March 1800 for one year of the same premises by Charles Pestell, John Reason and Jonathan Izod to Samuel Smith the younger. Witnessed and attested as before.
