Attested Copy Indenture of Marriage Settlement between Joseph Smith the elder of Birmingham ironmonger Joseph Smith the younger of Bristol merchant (eldest son and heir of the said Joseph Smith the elder) of the 1st part, Sarah Pope of Bristol widow Sarah Pope the younger granddaughter of the said Sarah Pope widow of the 2nd part and Thomas Deane esquire, Andrew Pope esquire John Anderson merchant all of Bristol and Brooke Smith of Birmingham aforesaid merchant of the 3rd part. Reciting that a marriage had been arranged between Joseph Smith the younger and Sarah pope the younger, it was thereby witnessed by that Joseph Smith the elder and Joseph Smith the younger in consideration of the said intended marriage (including the marriage portion of £1000 of the said Sarah Pope) and in consideration of 5/- apiece paid to them by Thomas Deane, Andrew Pope, John Anderson and Brooke Smith conveyed to the said Thomas Deane, Andrew Pope, John Anderson and Brooke Smith a half yard land in the Common Fields of Old Stratford also a parcel of land in the said Common Fields called Cook's Piece also a barn in Green Hill Street, Stratford-upon-Avon then in the occupation of John Payton to the use of Joseph Smith the elder until the intended marriage in fee simple and thereafter to the use of Joseph Smith the elder for life, remainder to Joseph Smith the younger for life to the use of the said Thomas Deane, Andrew Pope, John Anderson and Brooke Smith to support contingent remainders during the life of Joseph Smith the younger, remainder to the use of the said Sarah Pope the younger for her life (if she survive the said Joseph Smith the younger) for her Jointure and in lieu of dower, remainder to the use of the first and other sons of the said intended marriage successively in tail male, remainder to the use of the daughters of the said intended marriage as tenants in common, remainder to the use of the issue of such daughters in tail, remainder to the right heirs of Joseph Smith the elder.
