Description

Attested Copy Indentures of Lease and Release, the Release dated 3rd May 1799 between Joseph Smith of Bristol merchant of one part and John Lord of Stratford-upon-Avon gentleman of the other part reciting DR38/1397, it was thereby witnessed that Joseph Smith (in exercise of a power of appointment limited to him by DR38/1397) and in consideration of £1000 to him paid by John Lord conveyed to the said John Lord an allotment, upon inclosure of the Common Fields of Old Stratford, of land then divided into 2 pieces in Old Stratford on the West of and adjoining the Warwick to Stratford-upon-Avon road containing 21 acres, 0 roods and 14 perches bounded on the North East by land allotted to Samuel Heritage and by an allotment in Rowley Bank awarded to Samuel Heritage but exchanged by him to John Lloyd (see DR38/1366, on the South East by the Warwick to Stratford-upon-Avon road and on the South West and North West by land awarded to William Evetts and then belonging to Thomas Smith also another allotment in Old Stratford on the East side of the Warwick to Stratford-upon-Avon road containing 7a-0r-32p bounded on the North East by land awarded to James Keating, on the South East by the river and land awarded to John Partherithe esquire then belonging to Charles Boothby Clopton esquire and on the North West by the said Warwick to Stratford-upon-Avon road which parcels were allotted to Joseph Smith by an Award darted 21st January 1775 in lieu of half yard land in the Common Fields of Old Stratford and a piece of land called Cook's Piece also a barn situate in Greenhill Street, Stratford-upon-Avon then in the occupation of John Payton also two cottages and appurtenances in Ely or Swine Street, Stratford-upon-Avon. Witnessed by Richard Wyatt and Brooke Smith attorney at law, Bristol. Attested 24th September 1845 by R. W. Williams and Matthew Marshall, clerks to Messrs. Cunliffes, Charlewood Bury, solicitors, Manchester. Lease dated 2nd May 1799 for one year of the same property by Joseph Smith to John Lord. Witnessed as before.
