Description

Indenture of Mortgage between John Heritage of Stratford-upon-Avon butcher and Jane his wife of the 1st part, Samuel Heritage of the same place butcher only son of John Heritage of the 2nd part and Charles Henry Hunt of Stratford-upon-Avon esquire of the 3rd part. Reciting the Will of Samuel Heritage the elder (DR38/1368) and that the personal estate of the said Samuel Heritage the elder was insufficient to pay his debts amounting to £400 and that the said John Heritage had become indebted to Charles Henry Hunt in the sum of £450, it was thereby witnessed that John Heritage in consideration of £450 to him paid by Charles Henry Hunt conveyed to Charles Henry Hunt a messuage, garden and appurtenances in High Street, Stratford-upon-Avon theretofore in the tenure of Samuel Heritage deceased and then of John Heritage also a parcel of land in Old Stratford theretofore in the tenure of Samuel Heritage and then of the Reverend William Loggin clerk also a piece of land in Hampton Lucy called the Eleven Acres Meadow in the tenure of the Reverend John Lucy all which hereditaments were devised by the Will of Samuel Heritage (see DR38/1368) subject to a proviso for redemption upon repayment of £450 by John Heritage. Covenant by Samuel Heritage the younger that he would, if he survived his parents execute a new Mortgage to Charles Henry Hunt for the principal owing at that time.
