Alveston Old Stratford

Description

Attested Copy Marriage Settlement between John Higgins of Tiddington in the Parish of Alveston gentleman of the 1st part, Hannah Townsend of Alveston spinster of the 2nd part and Thomas Webb of Sherborne esquire and William Banbury of Toddenham, Gloucestershire gentleman of the 3rd part. Reciting that a marriage had been arranged between John Higgins and Hannah Townsend, it was witnessed that John Higgins in consideration of the intended marriage and of the marriage portion of £600 paid to Trustees upon trust as to £300 to pay off the debts of John Higgins and as to the other £300 in trust for the separate use of Hannah Townsend, conveyed to Thomas Webb and William Banbury a messuage in Tiddington and two yard and a half yard land in the Common Fields of Alveston and Tiddington in the occupation of John Higgins also a little close of meadow on the other side of the water (i.e. the River Avon) in the Parish of Alveston (sic) called the Slingatt (see map in DR38/1381) then in the tenure of Jonathan Southam all which premises were the estate and inheritance of John Higgins deceased, father of the above mentioned John Higgins and of Thomas Higgins, his grandfather likewise deceased and which premises were devised by John Higgins the father to John Higgins the son, also a meadow called Ham Meadow and another called Lord's Leys purchased by John Higgins the father and devised by him to John Higgins the son and all other the estate of the said John Higgins the son to the use of him John Higgins and his heirs until marriage and thereafter to the use of him John Higgins for life, remainder to the use of Hannah Townsend for her life if she survived her husband, remainder to the issue of the marriage in tail and in default of such issue to the use of the right heirs of John Higgins. Witnessed by Mary Farr and Thomas Townsend. Attested 5th February 1808 by John Lane and W. George, clerks to Messrs. Hunt Hobbes, Stratford-upon-Avon.
