Alveston Old Stratford

Description

Attested Copy Indenture (to lead to the uses of a Fine) between John Higgins of Alveston gentleman (eldest son and heir at law of John Higgins late of Tiddington gentleman deceased by Hannah his wife also deceased, formerly Hannah Townsend spinster) of one part and George Lloyd of Welcombe esquire and Robert Hobbes of Stratford-upon-Avon gentleman of the other part. Reciting DR38/1376 and also the Inclosure Award for inclosing the Common Fields of Alveston made in 1772 whereby 51 acres, 2 roods and 2 perches were awarded to John Higgins the elder in lieu of the said two yard and a half yard land, that is to say a plot of ground in Blackground Field containing 16a-2r-4p and another plot containing 34a-3r-38p in Blackground Field and Lower Westland also a little meadow called Two Leys then in the tenure of George Wood the elder and situate in Tiddington between the meadows belonging to John Higgins called Long Meadow and the Homestead containing 1a-1r-5p and reciting the marriage and deaths of the said John Higgins party to DR38/1376 and Hannah Townsend and that John Higgins party thereto was tenant in tail of the premises described in DR38/1376 and reciting DR38/1378 and that John Higgins was desirous of levying a fine of the premises described in DR38/1376 in order to bar the estate tail therein and to convey the said parcel to George Lloyd and settle the remaining portion of the premises, it was thereby witnessed that John Higgins the younger covenanted with George Lloyd and Robert Hobbes to levy a fine of the premises allotted to John Higgins the elder by the Inclosure Act of 1772 mentioned above also a messuage and several closes occupied therewith in Tiddington and al theretofore in the occupation of John Higgins the elder deceased and also premises described in DR38/1378 and the residue of the premises described in DR38/1376 such fine to enure as to and concerning the said parcel of land called the Slingatt to the use of George Lloyd and his heirs for ever and as to and concerning the residue of the premises to the use of John Higgins and his heirs for ever. Witnessed by Thomas Hunt and John Lane. Attested 1st February 1808 by John Lane and W. George, clerks to Messrs. Hunt Hobbes, Stratford-upon-Avon.
