Description

Indentures of Lease and Release, the Release dated 27th March 1751 between Finetta Holbech of Warwick spinster of the 1st part, William Holbech of Farnborough esquire Hugh Holbech formerly of Mollington, Oxfordshire but then of Warwick esquire of the 2nd part, The Honourable Heneage Legge esquire, one of the Barons of H. M. Court of Exchequer Robert Hasley the elder of Lincoln's Inn, Middlesex esquire of the 3rd part, John Palmer of the Middle Temple, London esquire of the 4th part and John Thompson of the said Middle temple, London gentleman of the 5th part. Reciting an Indenture dated 16th July 1743 between the said John Palmer of the 1st part, William Smith of Warwick gentleman (eldest son and Administrator with Will annexed of Francis Smith late of Warwick) of the 2nd part, the said Finetta Holbech of the 3rd part and the said William Hugh Holbech of the 4th part whereby John Palmer demised (inter alia) a meadow in Wolverton called Wolverton Meadow to Finetta Holbech for a term of 1500 years subject to a proviso for redemption and further granted to William Hugh Holbech the fee simple or reversion on the said term upon trust for Finetta Holbech until the sum of £2300 should be paid and thereafter in trust for John Palmer and reciting Indentures of 18th 19th June 1749 between John Palmer of the 1st part, several creditors of the 2nd part and Heneage Legge Robert Hasley of the 3rd part whereby John Palmer conveyed all his interest (held in trust for him) in the property described above to Heneage Legge and Robert Hasley in trust for the sale and satisfaction of his debts etc. and reciting that the said Heneage Legge and Robert Hasley had contracted with Finetta Holbech for the sale (inter alia) of the said meadow in Wolverton (called Wolverton Meadow) for £2800 and had agreed that the sum of £2615-3-13/4 due by John Palmer to Finetta Holbech upon the recited Mortgage should be satisfied out of the said sum of £2800, it was thereby witnessed that the said Finetta Holbech released the said Heneage Legge, Robert Hasley and John Palmer from the debt of £2615-3-13/4 and in consideration of 5/- paid to her by John Thompson assigned to the said John Thompson the residue of the term of 1500 years in trust to attend the inheritance of the said hereditaments and it was further witnessed that William and Hugh Holbech at the direction of Finetta Holbech and John Palmer, and in consideration of 5/- to each of them paid by Heneage Legge and Robert Hasley, conveyed the reversion (i.e. the legal estate) upon the said hereditaments including the said Wolverton Meadow to Heneage Legge and Robert Hasley upon the trusts declared in the Indentures of 18th 19th June 1749. Witnessed by Forth Winter, John Crooke, John Pitts, Robert Hunt junior, Edward Kenrick and Henry Claridge. Lease dated 26th March 1751 for one year of the same property by William Hugh Holbech to Heneage Legge and Robert Hasley. Signed William Holbech and Hugh Holbech.
