Description

Indentures of Lease and Release, the Release dated the 28th Sept. 1790 between Samuel Wright of Shipston upon Stower (Stour) Gent of the 1st part Charles Pestell of Stratford-upon-Avon Surgeon John Whateley of Chadshunt and Edward Townsend Higgins theretofore of Tiddington but then of Bridgetown in the Parish of Alveston Gents (Trustees of John Payton of Stratford-upon-Avon Gent) of 2nd part the said John Payton of the 3rd part and William Southam of Stratford-upon-Avon, Perukemaker of the 4th part Reciting No 52 (56) whereby John Payton conveyed (inter alia)the equity of redemption in the said four messuages to the persons of the 2nd part upon trust to sell for the benefit of his creditors. It was thereby witnessed that Samuel Wright in consideration of 10/-to him paid by Wm. Southam at the direction of Charles Pestall John Whateley and Edward Townsend Higgins in consideration of £140 to them paid by William Southam the said four cottages theretofore in the occupations Joseph Martin, William Minstrell, Simon Doughty and William Rhodes subsequently by Edward Lightfoot, Daniel Field, Daniel Hobbins and Thomas Rogers and then by William Warrilow - Summer- Grisnett and Thomas Hart which together with other adjoining premises were purchased by John Payton decd. Father of the said John Payton of the mortgagee of Thomas Hart. (Note, the piece of ground at the back of these cottages between the White Lion and the back gates of the Swan was re-conveyed to John Payton in 1808, see No 165) Signed Samuel Wright, Charles Pestall, John Whateley, Edward Townsend Higgins and John Payton. Seal of red wax a stag's head couped. Witnesses Thomas Smith, John Overton and Thomas Attwood . 2 membranes Lease dated the 27th Sept 1790 by Samuel Wright, Charles Pestall, John Whateley and Edward Townsend Higgins to William Southam of same property for one year. Signed and sealed as before (except for the omission of John Payton) Witnessed as before
