Description

Release and Counterpart between Thomas Hart of Stratford-upon-Avon (eldest son and heir apparent of George Hart of same place who was devisee of Ann Hart therefore of same place decd. Widow and devisee of Shakespeare Hart therefore of same place Glazier) 1st part Benjamin Smith of Hampton Lucy Yeoman of 2nd part John Payton the younger of Stratford-upon-Avon Innholder of 3rd part William Eaves of same place Sadler of 4th part and Thomas Taylor of same place joiner of 5th part Reciting TR46/1/15,16,18,19,20,17,18,22,23and 24 and that £250 was then owing by Thomas Hart to Benjamin Smith on the mortgage described in the TR46/1/20 and TR46/1/24 and also that John Payton had purchased the four cottages site of barn and appurtenances mentioned in TR46/1/21 and TR46/1/25 for £140 which run together with £60 advanced by Thomas Hart making £200 was agreed to be paid to Benjamin Smith in part discharge of the said mortgage. I was thereby witnessed that Benjamin Smith in part discharge of said mortgage. It was thereby witnessed that Benjamin Smith in consideration of £140 to him paid by John Payton and of £60 to him paid by Thomas Hart conveyed to William Eaves the premises described in TR46/1/25 to hold the same as to and concerning the first two mentioned messuages in the occupation of Joseph Jobson and Thomas Hart to the use of Benjamin Smith and his heirs subject to a proviso for redemption upon repayment to him of £50 by Thomas Hart and as to and concerning the residue of the premises to the use of John Payton and his heirs free from incumbrances and it was further witnessed that Thomas Hart assigned to Thomas Taylor the term of 500 years created by TR46/1/18 in the whole premises in trust as to the messuages in mortgage to Benjamin Smith for Benjamin Smith to attend the inheritance and as to the residue of the premises in trust for John Payton his executors administrators and assigns.Covenant by John Payton with Thomas Hart to build a party wall before the 29th Sept. 1771 between the premises sold to him and those retained by Thomas Hart. Release and Counterpart signed by Thomas Hart, Benjamin Smith, John Payton and Thomas Taylor. Seals in red wax a crowned pelican. Witnessed Wm. Hart and Thomas Cleaver. 3 membranes each.
