Description

Attested copies of Indentures of Lease and Release and the original Counterpart Release( being a Transfer of mortgage and Further mortgage), the Release dated the 21st Deceased. 1786 between William Eaves of Stratford-upon-Avon Gent of the 1st part John Payton theretofore of Stratford-upon-Avon, but then of Shottery, Gent (only son and heir at law of John Payton theretofore of Stratford-upon-Avon innkeeper decd.) on 2nd part and Samuel Wright of Shipston on Stour Gent of 3rd part. Reciting the creation of two mortgages in 1768 each in and undivided half moiety of lands in Welcombe described in DR38/1245 and DR38/1257 of the Trevelyan Collection and their subsequent transfer ( DR38/1257 and DR38/1259) at the direction of John Payton (only son and heir of John Payton the original mortgagor) to Wm. Eaves. It was thereby witnessed that William Eaves, in consideration of £2940 to him paid by Samuel Wright, at the direction of John Payton in consideration of £1560 to him paid by Samuel Wright conveyed the aforesaid premises of Welcombe to Samuel Wright subject to a proviso for redemption upon repayment of £4500 by John Payton to Samuel Wright and it was further witnessed that John Payton for better securing the said sum of £4500 conveyed to the said Samuel Wright a messuage (theretofore two) in Henley Street Stratford-upon-Avon adjoining the stables of the White Lion, then in the occupation of Wm. Irwin and theretofore part of the estate of Samuel Dennitt decd. And subsequently of Dorothy Bagg and Henry Dennitt who sold the same to John Payton decd. Also the four cottages, the site of barn and appurtenances described in TRT46/1/25 and sold by Benjamin Smith at the direction of Thomas Hart to John Payton decd. In 1771, see TR46/1/26 subject to a proviso for redemption upon repayment of the said sum of £4500 by John Payton to Samuel Wright Lease dated the 20th December 1786 by William Eaves and John Payton to Samuel Wright of same property for one year. Originals of attested copies (signed William Eaves and John Payton Witnessed Chas. J. Hunt and Thomas Smith his clerk) are DR38/1263 and DR38/1264 the above copies being attested the 9th October 1819 by Wm. George and J. Hobbins
