Transfer of Mortgage: Henley Street, Stratford-upon-Avon and Welcombe

Description

Release (being the transfer of a mortgage and a further mortgage) from William Eaves of Stratford-upon-Avon, gent., with the consent of John Payton theretofore of Stratford-upon-Avon but now of Shottery, gent., (only son and heir at law of John Payton theretofore of Stratford-upon-Avon, innholder, deceased) to Samuel Wright of Shipston-on-Stour, gent., (reciting the creation of two mortgages in 1768 each in an undivided half moiety of lands at Welcombe described in DR38/1245 and DR38/1257 and their subsequent transfer, DR38/1257 and DR38/1259) at the direction of John Payton the younger to William Eaves for £2940 to him paid by Samuel Wright, at the direction of John Payton, and for £1560 to John Payton paid by Samuel Wright, of premises at Welcombe subject to a proviso for redemption upon repayment of £4500 by John Payton to Samuel Wright; and it was further witnessed that John Payton for better securing the said sum of £4500 conveyed to Samuel Wright a messuage (theretofore two messuages) in Henley Street, adjoining the stable of the White Lion Inn, then in the occupation of William Irwin and theretofore part of the estate of Samuel Dennitt, deceased, and subsequently Dorothy Bagg and Henry Dennitt, who sold the same to John Payton, deceased; also four cottages, the site of a barn and appurtenances described in TR/46/1/25 and sold by Benjamin Smith at the direction of Thomas Hart to John Payton, deceased, in 1771 (TR/46/1/26). Witnesses: Charles H. Hunt and Thomas Smith, clerk to Mr. Hunt. Transfreerd to TR/46/1/56.
