Assignment of Lease: Nollands Farm, Honington

Description

Indenture of assignment between Hannah Howkins of Warmington, widow and sole executrix of John Howkins of the same place, maltster, deceased, of the first part, Thomas Chamberlain Hughes Chamberlain late of Shennington, co. Glos., but then of Wardington, co. Oxon., clerk and Anne, his wife (formerly Anne Snow) of the second part, Thomas Lambert Snow of Tidmington, clerk and Robert Edward Hughes of Shennington, clerk of the third part, John Munton of Banbury, gent. of the fourth part, Agnes Walford formerly Agnes Gibbs, widow of Theophilus Walford late of Waldershare, co. Kent, esq., deceased, of the fifth part, William Walford esq., Edward Gibbs Walford, clerk and Anne Walford, spinster, all of Banbury and only surviving children of William Walford, deceased, by Frances his wife (formerly Frances Gibbs) of the sixth part, Charles Wyatt of Banbury, banker, and Thomas Wyatt of Hanwell, co. Oxon. of the seventh part, James Wake Golby of Banbury, gent. of the eighth part and Thomas Cobb of Calthorp House in the parish of Nethrop, co. Oxon., banker of the ninth part (reciting ER3/2097-2139 and also that by ER3/2134 the mortgages vested in Hannah Howkins, and Thomas Snow and Robert E. Hughes, of £2,000 each and created by ER3/2111-2112 and ER3/2101-2014 respectively, had been satisfied and paid (by the sale of Nollands Farm to the trustees of Thomas Townsend's settlement), whereby it was witnessed that, in consideration of £2,000 paid to Hannah Howkins by the Trustees of the Marriage Settlement of Thomas Townsend (see ER3/2134) and in consideration of ten shillings to her paid by James Wake Golby, the said Hannah Howkins (as executrix of John Howkins) at the direction of Agnes Walford, William Walford, Edward Gibbs Walford, Anne Walford, John Munton and Charles and Thomas Wyatt, assigned to J. W. Golby the term of 1000 years in the residue of the premises settled by ER3/2102, not sold to the Townsends (and created by ER3/2111-2112) in trust for the persons of the fourth, fifth, sixth and seventh parts; and it was further witnessed that, in consideration of £2,000 paid to Thomas Lambert Snow and Robert Edward Hughes (with the consent of Thomas C. H. Chamberlain and Anne his wife) by the Trustees of the Marriage Settlement of Thomas Townsend (see ER3/2133-2136) and in consideration of ten shillings to them paid by Thomas Cobb, the said Thomas Lambert Snow and Robert Edward Hughes (with the privity of Thomas C. H. Chamberlain and Anne his wife and at the direction of Agnes Walford, William Walford, Edward Gibbs Walford, Anne Walford, John Munton and Charles and Thomas Wyatt) assigned to the said Thomas Cobb the term of 1000 years in the residue of the premises settled and created by ER3/2101-2104 (and not sold to the Townsends) in trust for the persons of the fourth, fifth, sixth and seventh parts. Witnesses: Edward Banister, Henry Hitchmough, W. Woolston, Thomas Kitts Walford of Uxbridge, Samuel Breadstry, his clerk, Elizabeth Hiorns, William Cleaver, M. Hughes and William Chesley.
