Attested copy of Indenture between John Munton and Thomas Draper both of Banbury, gents., of the first part, Ann Golby of Banbury, spinster, sister and heiress-at-law of James Wake Golby, of the second part, the Reverend Thomas William Lancaster of Magdalen College of the University of Oxford, clerk, and Anne his wife, formerly Anne Walford, spinster, of the third part and George Robert Michael Ward of Trinity College in the said University, esq., and John Whippy of the Lodge, Hillingdon, co. Middx., esq. of the fourth part (reciting ER3/2154-2157 and that James Wake Golby died in January 1842, having devised and bequeathed all his trust property to John Munton and Thomas Draper and appointed them executors of his will, and reciting that the part of the hereditaments settled by ER3/2154 remained unsold and that Thomas William Lancaster and Anne his wife had never had any issue and by reason of the advanced age of Anne Lancaster it was assumed that there would not be any issue of the marriage and therefore the said Thomas William Lancaster and Anne his wife were considered absolute owners in equity of the part of the premises described in ER3/2154; and reciting that Thomas William Lancaster and Anne his wife were desirous that Ann Golby should relinquish the trusteeship of the said premises and that John Munton and Thomas Draper should convey the same to George Robert Michael Ward and John Whippy), whereby it was witnessed that, in consideration of ten shillings paid by George Robert Michael Ward and John Whippy to John Munton and Thomas Draper, they, the said John Munton and Thomas Draper, at the request of Thomas William Lancaster and Anne, his wife and with the consent of Ann Golby, conveyed to George Robert Michael Ward and John Whippy the undivided fourth part of the premises described in ER3/2154, free from the trusts declared in ER3/2155 which were thereby revoked, but upon trust to sell the same during the lives of Thomas William Lancaster and Anne his wife or the survivor, with their consent in writing and thereafter at their own discretion, and to invest the proceeds of sale and pay the interest thereon (as well as any rents of the hereditaments until sale) to Anne Lancaster for her separate estate, and, after her death, to Thomas William Lancaster for his life, and after the decease of the survivor of Thomas William Lancaster and Anne his wife to such persons as Anne Lancaster should by will appoint, and in default of such appointment to her next of kin. Witnesses: Thomas Mitchell, clerk to Messrs. Munton, Draper and Munton, Solicitors of Banbury, Ann Lovell, J. Beesley, Solicitor of Banbury and John M. Davenport of Oxford.
