Draft case for opinion

Description

Goodwin Zouch of Shottery, farmer, and his son John entered into a bond for the repayment of £325 borrowed from George Wallington of Charlecote (a trustee for Miss Sarah Barker). During his life Goodwin Zouch surrendered the lease of a farm, together with stock, to his son who gave his father a bond for £800. Goodwin Zouch dying, left his wife Alice and daughter Ann Zouch, executrices. Alice and John entered into a new bond with Wallington. Alice during her life executed a deed of gift of all her property to her daughters, Mrs. [Margaret] Besant and Ann Zouch and died with no estate. Who is liable for repayment of bond to Wallington? If John Zouch, can it be set off against £800 due to father's estate?
