Mickleton papers

Papers in Chancery case, 1842-1849, William Barnacle Stratford-upon-Avon, auctioneer and Susannah Wrighton, spinster (trustees and executors of John Taylor, late of Mickleton, farmer), plaintiffs v. John Nightingale, Saintbury, farmer, purchaser of premises in re title to `Phipps Hole' and `Hunks Walk', Mickleton, settled/disentailed by John Taylor, 1743, devised by will, 27 February 1794, to his son Albright. Question arises over right of Albright to devise premises in which had only life interest and whether John his son, tenant in tail of his grandfather, could devise same (to trustees) or whether brother Samuel has rights as next male issue in tail of grandfather. Trustees have contracted for sale of premises to Nightingale who wishes to have secure title and refuses to complete until satisfied. Albright Taylor died 23 August 1809, will 20 June 1807. John Taylor made will 22 October 1840 devising to trustees to sell; died 31 Jan 1841. N.B. These papers are not in chronological order.
