Indenture quadrupartite of release between Lawrence Carter of [Leicester] co. Leics., gentleman and Thomas Ludlam of the same borough, mercer, of the first part, Sir Thomas Spencer of Yarnton, co. Oxford, baronet and Alice ffrank of [ ] widow, of the second part, Richard Holmes of Henley-in-Arden, co. Warwick, gentleman and John Morrell of the same, maltster, of the third part, and Simon Kempson of Henley-in-Arden [ ], John Hopkins of the same, ironmonger, Thomas Pain of the parish of Alchurch, co. Worcs., yeoman and Richard Bartlam of Shelfeild in the parish of Aston Cantloe, co. Warwick, yeoman, of the fourth part, reciting that Sir Thomas Spencer had agreed to sell to Richard Holmes, John Morrell, Simon Kempson, John Hopkins, Thomas Pain and Richard Bartlam his lands in Bewdesart als. Belsart, Wootton Wawen, Henley in Arden, and Ullenhall als. Oulnall, co. Warwick, for the sum of £4,357.10s., of which £2000 was to be paid to Alice ffrank for her assignment to the purchasers of several mortgages which she held on the said lands, and then witnessing that, in consideration of the £2000 so paid, Lawrence Carter and Thomas Ludlam, trustees of Alice ffrank, released and confirmed to Richard Holmes and John Morrell:- The close called the Rayl Parke of 90 1/2 acres, late in the occupation of Thomas Smith; The closes called Holmes his hill and Holmes his meadow, 23 acres together, late in the occupation of Thomas Smith and Thomas Cooper; Calves close and Penny Parke of c. 96 1/2 acres, both lately occupied by Thomas Cooper The Lodge ground (33 acres, Thomas Cooper) Bakers Parke and Danfords Parke, together 72 acres, then or late in the occupation of ffrancis Baker; The close called Parke lane of c.33 acres, late in the occupation of [blank] Harper, widow All which lands situate in Wootton, Bewdesart and Henley, co. Warwick, were parts of a certain ground formerly imparked or impaled for a Parke but then disparked, and then or formerly known as Henley Parke, and were by indenture quadrupartite dated 28 July 1674 between Sir Thomas Spencer of the first part, Thomas Boothby of Tooley Parke, co. Leics., esquire of the second part, Edmund Eyre Aderley of London, esquire and Ambrose Holbech of Mollington, co. Warwick, gentleman of the third part and Edward Bigland, serjeant-at-law, by the name of Edward Bigland of Grays Inn, co. Middx., esquire and Richard Hawkins, gentleman, since deceased of the fourth part, and by bargain and sale for a year dated the day before, and by a common recovery had in pursuance of the said indenture, granted and conveyed by Sir Thomas Spencer to Edmund Eyre Aderley and Ambrose Holbech in trust for Thomas Boot[h]by for the better securing to him the principal sum of £2000, and were by them afterwards conveyed to Lawrence Carter and Thomas Ludlam in trust for Alice ffrank, Simon Kempson and Richard Holmes, being then in actual possession of the premises by virtue of an indenture of bargain and sale dated the previous day and by force of the statute for transferring uses into possession.
