Attested copy of the Marriage Settlement between Robert Hobbes, Stratford-upon-Avon, gent., and Elizabeth Davenport Ashford, only child and heir of Thomas Ashford, Stratford-upon-Avon, saddlers ironmonger, deceased, and Sarah Ashford, Stratford-upon-Avon, widow. Trustees: Rev. James Davenport, Stratford-upon-Avon, D.D. and Charles Porter Packwood, Warwick. Reciting that Elizabeth Ashford is possessed of real property in fee simple as heiress at law of Thomas Ashford, deceased and that said Sarah and Elizabeth are entitled inter alia to principal sum of £1850, viz. £731 to Sarah and £1119 to Elizabeth, plus interest, which is residue due upon bond to secure a mortgage of £3300 lent by Thomas Ashford to John Lord, Stratford-upon-Avon, saddlers ironmonger. Property to Trustees. (i) messuage with stable, garden and appurtenances in Chapel Lane, wherein said Sarah and Elizabeth dwell, which were lately bought by Thomas Ashford of Charles Henry Hunt, gent., who had built house on site of 3 earlier dwellings. (ii) Moiety of messuage and appurtenances in High Street, Stratford-upon-Avon, formerly in the occupation of Thomas Ashford and now in the occupation of John Lord, which premises were purchased by Ashford and Lord from Charles Floyer, gent. To use of Elizabeth Davenport Ashford until marriage and then to joint use of Elizabeth and Robert Hobbes and the survivor or their assignees as they by deed or will direct. In default of any such appointment then In re (i) to use of Robert Hobbes for life, then to Elizabeth Hobbes for life, then to use of eldest son and heirs with successive remainders to subsequent sons. In default to daughters and heirs as tenants in common. In default to heirs and assigns of Robert Hobbes In re (ii) to the use and behoof of Robert Hobbes his heirs and assigns for ever. Right in principal and interest due upon bond. To trustees: to pay principal and interest due to Sarah Ashford. To hold residue for benefit of Elizabeth until marriage. And then to whatever purposes Robert Hobbes and Elizabeth Hobbes appoint; then if none, interest to Elizabeth Hobbes for life, then to Robert Hobbes for life, then interest equally for benefit of children. If only one then to be paid at 21 or marriage if daughter.
