Declaration of Trust between Catherine Mellish of Bush Hill, Enfield, co. Middx., widow and Susan Gore of Charles Street, Berkeley Square, co. Middx., spinster, of the one part, and the Honourable Thomas Windsor, Captain in the Royal Navy, Sir James Tylney Long of Draycot, co. Wilts., Bart., John Tempest of Winyard, co. Durham, esq. and John Mellish of Bishopsgate Street, London, esq. of the other part (reciting that Catherine late Countess Dowager of Plymouth, deceased, bequeathed to trustees £2,000 in trust for her daughter Lady Elizabeth, wife of Gore Townsend, for life with remainder to her grand-daughter Elizabeth Townsend, eldest daughter of Gore Townsend by the said Lady Elizabeth, and reciting that Catherine Mellish and Susan Gore were desirous of making further provision for Gore Townsend, their nephew, for his life and after his death for his younger children by Lady Elizabeth Townsend, for which purpose the said Catherine Mellish and Susan Gore had transferred to the persons of the second part two sums of £750 Bank of England Stocks) whereby it was agreed between all the parties thereto that the persons of the second part should be powered of the said £1,500 Bank Stock in trust to pay the dividends to Gore Townsend for life and thereafter in trust for the four younger daughters of Gore Townsend and the said Lady Elizabeth Townsend (namely Mary Ann Townsend, Harriet Townsend, Louisa Townsend and Horatia Townsend) with remainders over, in case of the death of the said four daughters of Gore Townsend before their respective interests became vested, to Henry Townsend, Charles Townsend, Edward [James] Townsend, William Townsend and John Townsend (the five younger sons of the said Gore Townsend and Lady Elizabeth Townsend) with remainder over, in case of the death of the said five sons of Gore Townsend before their respective interests became vested, to Elizabeth Townsend eldest daughter of Gore Townsend and the said Lady Elizabeth his wife, with remainder to the right heirs of Gore Townsend. Witnesses: William Atkinson, Anne Mellish, William Lawrence, Richard Gibbs, Benjamin Young of Swaffham, Norfolk, L. Fowler, and Anne Mellish the younger.
