Lease and Release the Release being a settlement between George Ferrers of Baddesley Clinton esq. of the first part, Mary Fitzherbert of Hints, co. Stafford spinster, Elizabeth Kempson of Hints spinster, Francis Willoughby of Cossall [Cossal], co. Nottingham gent., Walter Ashmore of Tamworth, co. Stafford gent. of the second part, Robert Lloyd of the city of Lichfield gent., Francis Garrat of Owsely Court gent. Richard Purcell of Wolverhampton, co. Stafford gent. and William Needham of Hints gent. of the third part previous to the marriage of the said George Ferrers and Elizabeth Kempson. The said George Ferrers in consideration of £1,700 paid to him by the said Mary Fitzherbert released to the said Francis Willoughby and Walter Ashmore the manors of Baddesley Clynton and Kingswood, the manor house of Baddesley, in the occupation of Henry Ferrers father of the said George, together with all lands and rights pertaining to the same, and lands called the Orchard, Oake yard, the garden, Barne field, Church field, Moat field, Lint alias Line field, Lodg field, Foure fields, Mill field adjoining to the Walleis, Great Walleis, Milking yard, Mill meadow, Dear meadow, Park meadow, Black meadow, Millholme, Mill pools, the Moate, the meadow adjoining Roxall pool head, the close at the side of Roxall pool and the close at Roxall pool tail, all three in the occupation of Robert Shakespere, Great Heathy field on Baddesley Hill or Common and one acre of meadow in Carters meadow, both purchased from John Wherrit in the occupation of Thomas Beck, a cottage and garden in the occupation of Thomas Boulton, a cottage, garden and piece of common land in the occupation of Edward Sydes, lands in the occupation of John Sandalls, Richard Knight, William Knight, Richard Burd, George Walker and Thomas Beck, a messuage in the occupation of George Walker and Richard Burd, freehold rents of 3s. per annum and all rights belonging to Courts Leet and Baron, lands in Baddesley Clinton called Great Gilberts, Gilberts Mill field, Little Gilberts, Gilberts meadow, Gilberts coppice, Great Chetwins, Great Green field, Birchy field, Three Long fields, Great Newlands, Arbor field, Little Moyers, Great Moyers, Little Black field, Walleis meadow, Great meadow, Heywood coppice, Birchy grove, Clay Pitt grove, Long grove, Round grove and Rowington coppice and a messuage and lands in the occupation of William Duncalfe formerly the inheritance of Edward Collett in Kingswood, Packwood, Knoll, Rowington, Baddesley Clinton and Lapworth. The said Francis Willoughby and Walter Ashmore to hold the same for uses described as follows: the lands called Great Gilberts [as above to Rowington coppice], the manor of Kingswood formerly belonging to Sir Thomas Cockaine knt. deceased, and Edward Cockaine esq., his son and heir, with all lands and appurtenances and the messuage and lands in the occupation of William Duncalfe formerly the inheritance of Edward Collett [as above] to be held for life to the said Henry Ferrers and Bridget his wife and after their death the said manor house and lands to pass for life in turn to the said George, Elizabeth and the male heirs of the said George or in default to the rightful heirs of the said George. The rest of the lands reserved to the said Henry and Bridget for their lives were to pass to the said George and his male heirs. Messuages and lands in the occupation of Richard Knight, Richard Bird, Robert Richardson, George Walker, Thomas Patston, Thomas Beck, John Sandalls, Clement Lucas, Thomas Boulton and Edward Sydes in Baddesley Clinton, the three closes adjoining Roxall pool in the occupation of Robert Shakespere, the closes called Rough Walleis, Smooth Walleis, the Mill field in the occupation of Mathew Mason, the Deere meadow, Mill meadow, Barne fields, Milking yard, Lodg field and Line field alias Lint field all in the occupation of the said George Ferrers to be held to the use of the said George and Elizabeth and their male heirs in turn, or in default to the said Richard Purcell and William Needham for a term of 500 years, and at the end or forfeiture of this term to the use of John, Thomas and Henry, the second, third and fourth brothers of the said George in turn, the said term of 500 years being granted to provide £30 per annum maintenance and £1,700 at the age of 18 years or upon the marriage of the only daughter of the said George and Elizabeth, or if there were more than one daughter, £20 per annum and £1,000 for the eldest daughter and £15 per annum and £500 for the younger daughters, however if these sums were paid in the life-time of the said George, this term was to be void, or if the said George and Elizabeth had no children, the said Richard Purcell and William Needham were to pay £400 as directed by the said Elizabeth and then the said term was to be void. Lands in Baddesley Clinton in the occupation of Widow Robbins and William London, the Parke field in the occupation of John Bacon and John Eales and one close in Kingswood in the occupation of William Green were to be held by the said Robert Lloyd and Francis Garratt for 99 years after the death of the said George to secure the jointure of the said Elizabeth from annuities of £30 due to the said brothers of the said George, the said term to be void when the annuities ceased to be paid. Copyhold lands in Rowington in the occupation of John Knight and John Clark were also to be held on the said terms. 19 and 20 September 1676. Lease signed: George Ferrers.
